while our journey has been long. we have picked ourselves up. we have fought our way back. and we know in our hearts, that for the united states of america, the best is yet to come. >> president obama will return to the white house this afternoon. he has no public events planned for today. before he declared victory mitt romney conceded gracefully. he told his supporters he called the president to congratulate him. he said it was time to put aside partisanship and work together for the good of the nation. >> i so wish i had been able to fulfill your hopes to lead the country in a different direction. but the nation another leader. ann and i join with you to earnestly pray for him and this great nation. >> president obama says he looks forward to meeting with romney in the weeks ahead to discuss ways to move the country forward. florida is still too

close call even without it, president obama dominated the must-have swing states. he also took the popular vet by a narrow margin. katie marzullo joins a look at that. >> reporter: this is how the popular vote breaks down. the numbers have fluctuated a little always hovered arm here, president obama with 51% of the popular vote and mitt romney with about 49%. -- this is interesting to see how close it was on the individual states, ohio look at ha, less than -- look at that, less than one percentage point. florida, again less than one percent between those two. california of course now you are go to see numbers like this, president obama with 54%. mitt romney 46%. a closer look at the state of

cal cool -- at the state of california. california voted democrat, but what might surprise you are these huge chunks of red all people who voted for mitt romney within california. those red counties don't have the juice, don't have the population density as the blue counties on the coast which turned the state blue and give the win to president obama. coming up, we'll look at the u.s. house of representatives map show you the interesting races decided there overnight. let's take a look at capitol hill. the president will face the same divided congress next year. democrats retain control of the senate, republicans keep control of the house. democrats have 52 seats, republicans have 54. three senate races are

undecided. 20 seats were a tossup, democrats needed 25 seats to gain control, no change in leadership there. >> governor brown's proposal to raise taxes to rescue schools was the big issue. the margin to approve it grew. prop 30 leading by six point margin most votes counted. consumers and high income earner will pay more in taxes. prop 38 would have increased taxes on the middle class to help fun education was soundly defeated. amy hollyfield joins us live with more. >> reporter: shopping is why a lot of people come to emeryville when you shop is when you are going to feel the affects of prop 30, a quarter cent sales tax increase to fund prop 30 the wealthy

californians will pay for the rest of prop 30 their income tax will go up between one and three percent. supporters of prop 30 were thrilled when they got word the measure was leading. this morning it was officially called that prop 30 had received support at the ballot box. governor brown staked his term as governor on this measure he pushed it hard, telling people there would be billions in cuts at the schools, if it failed. >> here we are, we have a vote of the people. i think the only place in america where a state said let's raise our taxes for our kids, for our schools. >> reporter: i just go off the phone with one of the lead opponents he said he's disappointed and predicts that voters will be surprised at the cost of this measure.

he did concede the governor did a good job of drumming up support. this measure was sometimes up in the polls, sometimes it was down. no one knew how this was going to go. this morning you can bet governor brown is breathing a huge sigh of relief. amy hollyfield, abc7 news. >> quick update, ap has called prop 30 passed. two more propositions, prop 34 the only one still not call it would replace the death penalty with life in prison without parole, it is trailing now. no 53%, yes 47%. now voters rejected prop 32 it would ban unions and corporations from using payroll deductions to fund political campaigns yes 40 five%, no 55%. upset in the east bay's

15th congressional district where congressman stark has been ousted. stark has been in congress for four decades he's 80-years-old and key architect of president obama's health care reform act. two democrats appeared on the ballot because of the top two rule. in the 9th district,dg2$v democt mcinnerney -- [ unintelligible ] a local measure that got national attention richmond voters rejected tax on sodas and sugary drinks that would have funded school programs.

city leaders are divided on the measure. >> tax on economically suppressed people, i've never been for this tax. >> we've run an education campaign the community is having a debate on this and that is wonderful. >> penny per ounce soda tax would have added 12 cents to every can of soda,. soft drink companies spent 2 1/2 million dollars to defeat it. palo alto voters say no to measure c which allows three medical marijuana dispensaries and creates 4% tax. palo alto has banned dispensaries since 1987. three marin county daycare workers under arrest for the death of a baby in their care are scheduled to appear in court this morning. the magic place infant and toddler daycare center remains closed. the woman who owns the business two of her staff were arrested after a four-month-old baby boy died two weeks ago. the three face charges of involuntary manslaughter women >> he died of asphyxia, suffocation due to his external airway blocked by bedding. it wasn't sids, he wasn't ill. it was caused by suffocation. >> an investigation by the state con clauded that the staff -- concluded the staff found baby at 3 p.m. and failed to call an ambulance for 25 minutes. the report says miss gill told the staff to tell police she had found the baby, not them. fresno police trying to determine a motive for a mass
